Auctrix Privacy Policy

  • 1. Introduction and Registration
    Auctrix is committed to protecting your and your family's personal information when you are using Workday (hereafter referred to as 'our supplier') Portal services for Auctrix (hereafter referred to as 'HR Portal'). We want our services to be safe and secure for our users. Uniform practices for collecting, using, disclosing, storing, retaining, disposing, accessing, transferring or otherwise processing such information assists Auctrix to process Personal Information fairly and appropriately, disclosing it and/or transferring it only under appropriate circumstances in a legally permissible manner.
    Your acceptance of this Agreement will enable you to register on this HR Portal and thereby avail of the employment and/or recruitment related services provided herein. Your use of this Portal and receiving the services is governed by the terms and conditions set out herein. This Agreement also governs our use of personal information that we may collect from you in order to enable us to provide you employment and/or recruitment related services.
  • 2. Information on the website
    All information provided on the Auctrix web site is provided on an 'AS IS' basis, without warranty of any kind, either express or implied, including without limitation any warranty for information, services or products and any implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by law.
  • 3. Applicability
    This Terms of Use applies to any visitor of the HR website of Auctrix, its operating units, and wholly owned subsidiaries worldwide.
  • 4. Lawful Use
    You agree to use and access the website(s) for only lawful purposes. You agree to do nothing that could compromise the security of the website(s), render the website(s) inaccessible or otherwise cause damage to the website(s) or its/their content.
  • 5. Collection and use of information
    • a) Collection of your information
      Your registration on this Portal, will require you to share certain information about you with Auctrix, which will be stored, processed, and retained by Auctrix.
      We may require you to provide us with information, such as your name, email address, mailing address, telephone number, or other information, which you may choose to share with us so that we can follow up with you after your visit. We may collect and store this information and combine this information with other personal information you may have provided, and use and process the same in accordance with this Agreement. The Personal Information required to be provided by you may include, but is not limited to:
      • i. Your name and physical address, email addresses, and telephone numbers
      • ii. Behavioural or demographic attributes, when tied to personal identifiers
      • iii. Previous Employment Details
      • iv. Financial and bank account details
      • v. Employment records
      • vi. Background checks
        You authorize former employers and educational institutions to provide information concerning you, and you release them from liability for providing any such information to Auctrix.
    • b) How we use your information
      Any of the information we collect from you may be used in one of the following ways:
      • i. To provide employment related services: We shall process your personal data for financial, accounting, payroll and compensation, rewards and re-imbursement benefits, succession and resource planning in relation to employment related services.
      • ii. To gather details about prospect employees: Your information helps us to more effectively respond to your requests and queries to make the application interface user friendly.
      • iii. To process transactions: We may use Personal Information along with financial, credit card, and payment information this will be for purposes of Payment.
      • iv. To send periodic emails: The email address you provide will be used to send you information and updates pertaining to employment within Auctrix.
      • v. Select Content, Improve Quality and Facilitate Use of the other interface channels : Auctrix may use your Personal Information to help create and personalize content on our Channels, facilitate your use of the Channels (for example, to facilitate navigation and the login process, avoid duplicate data entry, enhance security, improve quality, track campaign and survey responsiveness and evaluate page response rates.
      • vi. Obtain Third Party Services: We also share Personal Information and Other Information with third parties who provide services to Auctrix website management, information technology and related infrastructure provision, customer service, e-mail delivery, auditing, and other similar services. When Auctrix shares Personal Information with third party service providers, we require that they use your Personal Information and Other Information only for the purpose of providing services to us and subject to terms consistent with this Policy.
      • vii. For Auctrix business purpose (Client business engagement or business partners or suppliers) : Your limited Personal information may be shared with the business partners or suppliers to contact you in relation of you managing the Auctrix business activities or business activities related services managed by the business partner or Supplier. Likewise, limited personal information may be shared with the client to provide you the access to their systems or information.

        For new users or Prospects : If you choose not to provide the mandatorily required information required by us to process your data, your registration will remain incomplete and we may not be able to process your request and/or respond to you. Similarly, if you choose to delete or withdraw any mandatorily required information provided by you to us, we will be unable to continue to process your request and/or respond to you. In such instances, Auctrix may, at its discretion choose to deactivate your registration.

  • 6. Accuracy of information
    The information held by Auctrix on the HR portal shall be checked with you from time to time to ensure that it remains up-to-date. Should your personal circumstances change, you should notify the human resources department and update your details on the HR portal immediately.

    You are required to review the information provided by you carefully to ensure its correctness and accuracy prior to submission of the same. If any information provided by you is found to be falsified, Auctrix will be entitled to deactivate your account after notice to you and you may be liable for civil and/or criminal action for misrepresentation under applicable law.
  • 7. Distribution/Sharing of Information
    • a) Information Disclosure
      Auctrix does not share, sell, rent, or trade personal information collected through its HR portal with third parties for their sole promotional purposes or as otherwise outlined in this Privacy Statement. Auctrix may share information with third party service providers contracted to provide services on our behalf for processing to provide your employment related services and benefits and other business purposes. These third party service providers may only use information we provide to them as requested and instructed by Auctrix.

      Auctrix may share information to affiliates, third parties and client pursuant to a legitimate purpose, such as but not limited to identification and prevention of fraud in connection with your assignment with the client.
      • i. Auctrix may disclose your Personal Information as we believe to be necessary or appropriate:
        • 1. under applicable law, including laws outside your country of residence;
        • 2. to comply with legal process;
        • 3. to respond to requests from public and government authorities, including public and government authorities outside your country of residence, for national security and/or law enforcement purposes;
        • 4. to enforce our terms and conditions; and
        • 5. to allow us to pursue available remedies or limit the damages that we may sustain.
      • ii. Additionally, in the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings), we may transfer the Personal Information we have collected to the relevant third party.
      • iii. We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when:
        • 1. permitted or required by law; or,
        • 2. trying to protect against or prevent actual or potential fraud or unauthorized transactions; or,
        • 3. Investigating fraud which has already taken place. The information is not provided to these companies for marketing purposes.
        • 4. Auctrix may provide your name and your status as ineligible for rehire to any Auctrix client for whom you do work if you are terminated by Auctrix and considered ineligible for rehire by Auctrix.

          If Auctrix goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal information collected through our website(s) may be among the assets transferred. A prominent notice will appear on our website(s) for 30 days after any such change in ownership or control of your personal information
  • 8. Cross-Border Data Transfers
    When conducting business, working on Company projects, or implementing new processes or systems, an operation may require the transfer of personal information to other entities or third parties that are located outside of the Auctrix operation’s country of business. While permissible data transfer mechanisms are defined by applicable law or regulation, examples include:
    • i. a data transfer agreement with the party who will access or obtain the personal information;
    • ii. notice to and/or approval from a country’s local data protection authority; or
    • iii. notice to and/or consent from the individual whose data is to be transferred.
      All information shared by you will only be used for the purpose provided Information about your visit will be used internally at Auctrix, and may involve the transfer of your personal information to third party companies, but only for the purposes of providing you with services in connection to your employment related services.

      Please note that such transfer of information could be made outside the European Economic Area. We will continue to use European Commission-approved Standard Contractual Clauses as a legal mechanism for data transfers from the EU. As explained in the EU Data Protection Unit FAQ, these clauses are contractual commitments between companies transferring personal data binding them to protect the privacy and security of the data.
  • 9. Acceptance and Control
    • a) Acceptance and Consent
      Your consent and acceptance of this Terms of Use document is mandatorily required to register yourself on the Auctrix HR Portal, if you wish to avail of any of the above services, You may additionally choose to avail of any additional services by way of “opting-in” for such service by ticking the appropriate check box confirming that you understand and agree to the processing of your personal information in the manner required to obtain that particular service.

    • b) Control of your information
      Auctrix also provides you the right to control your personal information, which includes the right to access, modify, erase, restrict, transmit, or object to certain uses of your information.

      You are also requested to review, correct and update or otherwise modify any of your Personal Information that you have previously provided to us through HR Portal from time to time or generated during the employment or recruitment services, in order to keep your profile updated, so as to ensure the best of services from us. You have the ability to update your HR Portal profile and related Personal Information at any time. To change this information, please login and follow the prompts to 'update my profile.'

      If you have questions about your account or are having trouble accessing your account, you can get answers to Frequently Asked Questions (FAQs) and request help with on your account. If you have privacy concerns regarding access to or the correction of your Personal Information, please contact us at privacy contact information mentioned within Section 13 'Privacy Contact Information' of this policy. In your request, please make clear as to what Personal Information you have a request for and what action is desired.

      While the majority of questions and issues related to access can be handled quickly, complex requests may take more research and time. In such cases, issues will be addressed, or you will be contacted regarding the nature of the problem and appropriate next steps, within thirty days.
  • 10. Data Storage

    Auctrix may transfer your information from HR Portal to other HR systems and store it on Auctrix or other supplier systems.
  • 11. Commitment to data security
    Your personally identifiable information is kept secure. Only authorized employees, business partners, clients, vendors and other third party providers (who have agreed to keep information secure and confidential) have access to this information.
    Auctrix ensures that our supplier employs industry standard security measures to ensure the security of information through legally binding terms and conditions. However, users of our HR portal are responsible for maintaining the security of any password, user ID, or other form of authentication involved in obtaining access to password protected or secure areas of any Workday websites. Access to and use of password protected and/or secure area of HR portal is restricted to authorized users only. Unauthorized access to such areas is prohibited and may lead to criminal prosecution.
  • 12. Retention and disposal
    Auctrix Personal information shall be retained only as long as necessary for the fulfilment of the stated purposes, and shall be disposed thereafter. We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us via the information above. We will respond to your request to access within 30 days.
    We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
  • 13. Supplier Obligations
    Our Supplier, being the cloud service provider for HR Portal and therein being the custodian of information will be liable for management of the following:
    • a) security of the personal information
    • b) appropriate retention and disposal of personal information (as per agreement with Auctrix)
    • c) appropriate storage of personal information
    • d) usage of web cookies

  • 14. Acceptance
    Please refer to end of this policy for providing your Acceptance of this Agreement. Your consent to this Agreement and personal data collection and processing may be revoked by deactivating your account or by notifying us via our contact page.
  • 15. Breach
    If you believe that your privacy has been breached, please contact us using the contact information below and provide details of the incident so that we can investigate it.
    Our procedure for investigating and dealing with privacy breaches is to ascertain all relevant facts and correspond with those involved (including where relevant our clients), reach a view as to the existence, scope and cause of the issue, and where relevant and appropriate, implement corrective or rectification measures, in accordance with applicable law.

  • 17. You acknowledge and agree that in connection to your future employment with Auctrix and assignment to any of its Client accounts that you will undergo finger scanning whenever required which would entail the collection, storage and processing by Client or Auctrix or any of its representatives or third party provider or partners, of your name, finger prints, or any other identification for the whichever purpose it may serve in relation to your future employment with the Company. You further agree that the reports and data from such finger scanning will be further processed by the Client which may include reporting to Financial Industry Regulatory Authority (FINRA) or other authority, as needed, and disclosing the same to Auctrix, in support of the above-mentioned Purpose.
    In so giving this consent, you hereby warrant that my consent is freely given and is an informed indication of your will and that you have read and understood your rights and obligation as specifically stated in the Data Privacy Act of 2012 and its implementing rules and regulations.
  • 18. I, hereby represent and warrant that I am not bound by any non-compete obligations or other restrictive covenants with any previous employer (collectively referred to as 'Prior Obligations'). I further warrant that my seeking and/or acceptance of any offer of employment from Auctrix (if offered) will not be in breach of Prior Obligations and that I agree to indemnify Auctrix in respect of any loss or damage that Auctrix may suffer directly or indirectly from any breach of Prior Obligations. I also represent and guarantee my full cooperation with Auctrix in case my assistance is needed in any proceeding or in any other manner in relation to any claim that may be filed against Auctrix related to my Prior Obligations.
